Assemblywoman Aura Dunn Calls for Assistant AG’s Firing over Voter Disenfranchisement

TRENTON, N.J. – The assistant attorney general should be fired for her alleged actions that potentially led to thousands of voters being disenfranchised from voting in New Jersey’s most expensive and hotly contested primary election on record, Assemblywoman Aura Dunn says.

 

Unnamed election officials from across the state told the New Jersey Globe they were instructed by Assistant Attorney General Susan Scott, who runs the Law Division’s Election office, not to inform voters of their right to appeal the decision to bar them from voting in the June 10 primary or early voting starting June 3.

 

According to the Globe, voters who sought to obtain a Real ID were asked to register to vote, whether they were already registered, and asked to confirm their party affiliation. Thousands of voters who visited the Motor Vehicle Commission since April 17 received auto-generated letters from superintendents of elections and county election boards, at the direction of Scott, alerting them of their ineligibility to vote due a party affiliation change that occurred after the deadline; state law prohibits party changes 55 days before a primary election.

 

Dunn said it appears many of these voters made honest mistakes that should be permitted to be corrected, allowing them to vote in the 2025 Primary.

 

“Instead, we’re being told that Scott and her representatives are telling election officials not to tell voters they can appeal to a judge to vote in the primary,” Dunn (R-Morris) said. “If that’s not voter disenfranchisement and a lack of due process, I don’t know what is. If true, she should be fired immediately.”

 

Thus far, several judges have allowed affected voters to cast ballots in the primary. However, another judge rejected the appeal of another voter who claims she accidentally changed her party affiliation while applying for her Real ID at an MVC kiosk.

 

Election officials also told the Globe over the weekend they offered voters provisional ballots, which can be used when a person’s party affiliation is unclear or mismatched, but none “proactively offered up the right of a voter to appear before a judge.”

 

“Attorney General Matt Platkin released a statement the day before early voting promising a fair and smooth-running primary election. His own assistant attorney general appears to be undermining that,” Dunn said. “Rather than seeking to redress a problem that impacted thousands of voters—Democrats and Republicans—Scott’s actions undermine the very bedrock of our constitutional republic."

 

“Platkin said, ‘We have the systems in place to address and resolve voting-related issues as they arise, and we will not tolerate any attempts to interfere with or disrupt our democratic process.’ Mr. Platkin, keep your word.”
